Recent Matters
- Susan Burton and Michelle Alcala, attorneys in Graves Dougherty’s Employment Law group, recently obtained a summary judgment in an FMLA retaliation case for an employer in the waste removal and disposal services industry. The plaintiff in this federal court case alleged that he was fired because he told his employer he needed to be off work to have surgery and that the firing thus was illegal under the FMLA. GDHM filed a motion for summary judgment and contended that plaintiff had been fired for violation of workplace policies and procedures; therefore, no FMLA violation had occurred. The Court granted GDHM’s Motion and dismissed all of plaintiff’s claims. The plaintiff appealed the case to the Fifth Circuit and the Fifth Circuit affirmed the summary judgment in favor of GDHM’s client.
