REPRESENTATIVE EXPERIENCE

Preston represents local and national clients in a wide variety of disputes, including those involving contracts, fraud, fiduciary duties, and business torts.

He has significant experience in real estate and construction litigation and has represented commercial developers, residential and commercial general contractors, land and building owners, subcontractors, suppliers, engineers, brokers, landlords, and tenants.

Recent experience includes:

• Handled construction and design disputes involving structural and foundation engineering and construction, building envelop construction and design (including roofing design and construction), site plan and subdivision design and construction (including civil engineering), mechanical engineering and construction of mechanical systems, mold, statutory and constitutional lien claims, payment bonds, performance bonds, and contract interpretation/enforcement.
• Handled construction and land claims involving both horizontal and vertical development, including commercial multi-story buildings, residential homes, roads, highways, commercial and residential subdivisions, and land entitlement issues.
• One of the primary lawyers representing the prevailing party in the Texas Supreme Court case, Alex Sheshunoff Management Services v. Johnson, 209 S.W.3d 644 (Tex. 2006), a landmark case now used by employers and lawyers to draft and enforce non-compete agreements.
