Prospective Challenges to Constitutionality of Laws

In addition to defending lawsuits, over the years Graves Dougherty's lawyers have developed extensive experience in proactively challenging laws and policies that violate the First Amendment and the Texas Constitution, including laws restricting advertisements, restricting the use of public information, and limiting investment choices, among others.

 

    Nolo Press v. Unauthorized Practice of Law Committee: Filed lawsuit challenging constitutionality of effort by UPL Committee to ban self-help law books and software in Texas.

    RIAA v. State of Texas: Obtained summary judgment that law prohibiting state retirement funds from investing in companies that publish music with violent lyrics violated the Texas Constitution.

    Texas Daily Newspaper Association v. State of Texas: Obtained state-wide class action judgment holding that Texas' restrictions on access to accident reports violated the First Amendment right of access of the media to public information.
