Privacy

Graves Dougherty lawyers have defended numerous invasion of privacy claims made against the media, such as:

New Times, Inc. v. Doe, 183 S.W.3d 122 (Tex. App. – Dallas 2006, no pet.) (won dismissal on interlocutory appeal of claim that publication of plaintiff's HIV status in newspaper article violated Texas Communicable Disease Prevention and Control Act)

Ross v. Midwest Communications, Inc., 870 F.2d 271 (5th Cir. 1989) (affirming summary judgment dismissing crime victim's invasion of privacy claim, holding that publication of name was constitutionally protected because of legitimate nexus between information revealed and program broadcast).

Faloona by Frederickson v. Hustler Magazine, Inc., 799 F.2d 1000 (5th Cir. 1986) (obtained summary judgment dismissing invasion of privacy claim based on publication of photograph in connection with book review).

Wood v. Hustler Magazine, Inc., 736 F.2d 1084 (5th Cir. 1984) (in obtaining partial dismissal of claims on appeal, case established statute of limitations for invasion of privacy cases in Texas and determined standard for invasion of privacy cases involving public disclosure of private facts).

Graves Dougherty lawyers have also prosecuted invasion of privacy claims against the government and private businesses, including:

Fleishman v. Sportexe, Inc., U.S. District Court, Western District of Texas (2006) (represented individual and business against former employer accused of surreptitiously using spyware software to monitor and disrupt competing business; obtained substantial monetary recovery for clients through settlement).

Steve Jackson Games, Inc. v. U.S. Secret Service, 816 F. Supp. 432 (W.D. Tex. 1993), aff'd, 36 F.3d 457 (5th Cir. 1994) (finding United States Secret Service liable and awarding damages for violating the Privacy Protection Act and Electronic Communications Privacy Act when Secret Service conducted a botched search and seizure of computers at a small Austin game publisher).
